Child Support Arrearages

Calculating Child support arrearages can be complex and frustrating. Making matters worse can be collecting child support from a parent who fails to pay child support in accordance with Nevada Child Support Laws or in compliance with a court order. In these situations it may be necessary to hire an attorney to collect current or past-due support payments.

Child Support Enforcement Measures

  • Withholding child support from paychecks or and unemployment benefits
  • Filing liens on bank accounts, cash accounts or income tax returns
  • Placing liens on real property assets
  • Suspension Nevada driver's license or other professional license
  • Suspension or revocation of the parent's U.S. passport
  • Filing contempt of court actions

Nevada Child Support Points of Interest

The amount of support is determined by a formula defined in Nevada Revised Statute 125B.070 (calculating child support). If the amount of support agreed to by the parents deviates from the established formula, then the parties must provide to the court sufficient facts justifying the deviation and the court must make a written finding based on these facts.

Child support is charged until the child reaches the age of majority unless the child has mental or physical abilities as determined by the court. The age of majority, in Nevada, is 18 or 19 if the child is in high school and expects to graduate by age 19.

Nevada allows for interest on past due child support and a 10% penalty may by imposed. The interest rate is either specified in the decree of typically established as the prime rate, at the largest bank in Nevada, plus 2%.

The Division of Family and Support Services is the state-run child support enforcement office for Nevada. This agency can help with child support calculations and enforcement.

Under Nevada law, there is no statute of limitations on child support enforcement if a court order exists. If an order does not exist, retroactive support for a period of 4 years may be requested.

Child support and visitation rights are separate issues. The court determines both and will usually order the non-custodial parent to pay support and the custodial parent to make the child available for visits. The custodial parent must obey the court order for visitation, even if the non-custodial parent cannot or will not pay child support.
