What Is Legal Custody? Legal custody is often confused with physical custody, but it is important to know the difference. Physical custody is where the child resides, whereas legal custody involves having basic legal responsibility for a child and making major decisions regarding the child, including the child’s health, education, and religious upbringing.
What Is Physical Custody? Physical custody involves the time that a child physically spends in the care of a parent. During this time, the child resides with the parent and that parent provides supervision for the child and makes the day to day decisions regarding the child. Parents can share joint physical custody, or one parent may have primary physical custody while the other parent may only have visitation rights.
Can I Move To Another State With My Child? A custodial parent may move to another state if they obtain the written consent of the non custodial parent to move. If the non custodial parent refuses then the custodial parent may petition the court for permission to move.
How Does A Court Determine Child Support? Calculation of child support is based a percentage of gross monthly income, and depends if the parties have joint physical custody or if one parent has primary physical custody.
