Consequences of Violating a Child Custody Order

Violating a child custody decree happens more than it should. Continuous and deliberate acts of a parent violating the decree can land a parent in jail. In a bold move, a New York Family Court judge ordered a mother to be jailed for repeatedly violating the terms of the court orders regarding the father’s parenting time. The court determined the mother "has to be penalized in a way that she is forced to learn that court orders have teeth and can be enforced. Jail time for her contempt of court may be the only punishment she understands."

While Family Law judge's in Las Vegas, Nevada may not order jail time, the family law courts have ordered a change of custody if the evidence shows there is a long established history where a parent continually interferes with the other parents' rights. Judges will not approve of a parent Willfully attempting to alienate the children from the other parent. This not only includes violating the court order, but can include false reports of child abuse, bad-mouthing the other parent in the presence of the children, and deliberately scheduling family events during the other parent's visitation time.

Unfortunately, before the courts finally figure out what is happening, the damage may be done. For example, in the New York case, the father may still come out the loser, since the children are so turned against him that they will actually blame the father for putting the mother in jail.
