According to Nevada statutes 125.105 the primary consideration in a court terminating parental rights must be whether the best interests of the child will be served by the termination. Additionally an order of the court to terminate of parental should be substantiated by findings of;

  • Parents abandonment
  • Parent neglect of the child
  • Unfitness of the parent
  • Risk of serious physical, mental or emotional injury to the child
  • Minimal effort of the parent to support of communicate with the child.

Courts may be more open with voluntary termination in cases of adoption. However, they set high standards when one parent argues against the loss of their rights. As with any area of family law practice the best interests of the child come first.
